1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of Thinkgage ("Service"), operated by Thinkgage ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and references to "you" include that organization.
2. Description of Service
Thinkgage is a SaaS platform that helps enterprises plan, generate, approve, and publish thought leadership content on LinkedIn. Key features include:
- AI-powered post generation using configurable angles, content rules, and brand voice settings
- Integration with the LinkedIn API to publish content to personal profiles and company pages
- Post approval queues, scheduling, and analytics dashboards
- Multi-user workspace collaboration with role-based access
3. Eligibility and Accounts
3.1 Eligibility
You must be at least 18 years old and have the legal authority to enter into these Terms. The Service is intended for business use; consumer use is not the primary intended purpose.
3.2 Account Registration
You must provide accurate and complete registration information. You are responsible for maintaining the security of your account credentials and for all activity under your account. Notify us immediately at info@thinkgage.io if you suspect unauthorized access.
3.3 Workspaces and Teams
Accounts are organized into workspaces. The workspace creator is the owner and may invite additional team members with defined roles (e.g., Admin, Member). Owners are responsible for managing member access and ensuring all members comply with these Terms.
4. LinkedIn Integration and Your Responsibilities
4.1 Authorization
To use publishing features, you must connect a LinkedIn account or company page and grant Thinkgage the required API permissions. By doing so, you authorize Thinkgage to take actions on LinkedIn on your behalf as directed by your configurations and approvals.
4.2 Your Content
You are solely responsible for all content published through the Service, including AI-generated content that you approve and publish. Before approving any post, you must review it to ensure it is accurate, compliant, and appropriate for publication. Thinkgage is a tool to assist content creation — you remain the publisher of record.
4.3 Compliance with LinkedIn Policies
You agree to use the Service in compliance with:
- LinkedIn's User Agreement and Professional Community Policies
- LinkedIn's API Terms of Use
- Any other applicable LinkedIn platform policies
You must not use Thinkgage to publish spam, misleading content, hate speech, or any content that violates LinkedIn's policies or applicable law. Violations may result in suspension of your LinkedIn integration or termination of your Thinkgage account.
5. Acceptable Use
You agree not to use the Service to:
- Publish false, misleading, defamatory, or deceptive content
- Violate any applicable law, regulation, or third-party right
- Attempt to gain unauthorized access to the Service or related systems
- Reverse-engineer, decompile, or create derivative works of the Service
- Use automated tools to scrape, index, or harvest data from the Service without our permission
- Overload or disrupt the Service or its infrastructure
- Impersonate another person or entity
We reserve the right to suspend or terminate accounts that violate these restrictions.
6. AI-Generated Content and Your Approval Obligation
The Service uses large language models and other AI tools to assist with content drafting. No post is ever published automatically. Every post requires your explicit manual approval before it is submitted to LinkedIn.
You are the publisher of record. By clicking 'Approve' on a post, you confirm that you have read the content in full, that it is accurate and appropriate, and that you authorize Thinkgage to publish it to LinkedIn on your behalf. From that moment, the content and all consequences of its publication are your sole responsibility.
You specifically acknowledge that:
- No post is published without your explicit approval — Thinkgage never publishes content autonomously
- AI-generated drafts may contain errors, inaccuracies, outdated information, or material that does not reflect your intended message
- It is your obligation to review every draft carefully before approving it
- Thinkgage does not guarantee the accuracy, quality, legal compliance, or suitability of any AI-generated content
- Thinkgage bears no responsibility or liability for content you have approved and published, including any claims arising from third parties, LinkedIn policy violations, reputational harm, or legal consequences
If you are approving posts on behalf of an organization or company page, you represent that you have the authority to do so and that your organization accepts these responsibilities.
7. Intellectual Property
7.1 Your Content
You retain all ownership rights to content you create, configure, or publish through the Service, including AI-generated content you approve. By using the Service, you grant us a limited, non-exclusive license to store, process, and transmit your content solely to provide the Service.
7.2 Our Technology
The Service, including its software, AI models, interfaces, and underlying technology, is owned by Thinkgage and protected by intellectual property law. You may not copy, reproduce, or create derivative works from our technology without express written permission.
7.3 Feedback
If you provide feedback or suggestions about the Service, we may use that feedback without restriction or obligation to you.
8. Privacy
Our collection and use of personal data is governed by our Privacy Policy, available at https://thinkgage.io/privacy. By using the Service, you consent to the practices described there.
9. Fees and Payment
Thinkgage may offer both free and paid subscription tiers. Pricing, billing terms, and refund policies will be posted on our pricing page when paid plans are introduced. We reserve the right to change pricing with reasonable notice. Continued use of a paid plan after a price change constitutes acceptance of the new pricing.
10. Term and Termination
10.1 Term
These Terms remain in effect as long as you maintain an account with Thinkgage.
10.2 Termination by You
You may delete your account at any time through the account settings. Deletion will remove your data in accordance with our Privacy Policy.
10.3 Termination by Us
We may suspend or terminate your account at any time, with or without notice, for:
- Material breach of these Terms
- Conduct that puts the Service, other users, or third parties at risk
- Non-payment of applicable fees
- Legal or regulatory requirements
10.4 Effect of Termination
Upon termination, your right to use the Service ceases. We may retain certain data for legal compliance purposes as described in our Privacy Policy.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THINKGAGE DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will meet your quality requirements or comply with all platform policies.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THINKGAGE AND ITS AFFILIATES, OFFICERS, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, REPUTATION, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
OUR AGGREGATE LIABILITY TO YOU FOR DIRECT DAMAGES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID THINKGAGE IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $100.
13. Indemnification
You agree to indemnify and hold harmless Thinkgage and its affiliates, officers, and employees from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your use of the Service
- Content you publish through the Service
- Your violation of these Terms or applicable law
- Your violation of LinkedIn's policies or any third-party rights
14. Third-Party Services
The Service integrates with third-party platforms including LinkedIn, Google Cloud, and AI providers. Your use of those platforms is subject to their respective terms. We are not responsible for the availability, accuracy, or conduct of third-party services.
15. Changes to Terms
We may update these Terms at any time. Material changes will be communicated by updating the "Last updated" date and, where appropriate, by email. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
16. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or the Service shall first be attempted to be resolved by good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction in the applicable territory.
17. Miscellaneous
- Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Thinkgage regarding the Service.
- Severability: If any provision is found unenforceable, the remaining provisions remain in full force.
- No Waiver: Failure to enforce any provision shall not constitute a waiver of future enforcement.
- Assignment: You may not assign your rights under these Terms without our consent. We may assign our rights without restriction.
